Texas State and Local Government


When no candidate receives more than 50% of the vote in any Primary, a runoff is held between the two top vote-getters.

In Special Elections, all candidates, regardless of party affiliation, run on a single ballot. If one candidate receives a majority of the vote, that candidate is elected. Otherwise, the top two vote-getters advance to a runoff.

The Green and Libertarian parties may nominate by convention.

The minor parties are: None of the Above, America’s Party, Christian Party, Green Party, Libertarian Party, and the Texas Independent Party. The minor parties that have ballot access are the Green and the Libertarian Parties.

1 July 2025: New Mexico now has open primaries. Decline-to-state voters (voters who have not registered with a major or minor party) can participate in New Mexico Primary Elections without changing their registration status.

27 May 2023: The Texas House voted 121-23 to suspend Attorney General Ken Paxton (Republican) and refer him to the Senate for trial on 20 articles including bribery, abuse of office, and obstruction. The suspension is in effect until the outcome of the Senate trial. Permanently removing the Attorney General requires a vote of 2/3 of the state Senate. Paxton was first elected in 2014, re-elected in 2018, and 2022. Brent Webster, 1st assistant attorney general, by state law, became acting Attorney General when the Attorney General is "absent or unable to act."
30 May 2023: The state Senate passed a resolution stating the trial for Attorney General Ken Paxton must begin not later than 28 August 2023.
